Prohibition on Unmanned Aircraft Systems From Covered Foreign Entities (Interim Rule)

A new rule has been put in place (as of 11/12/2024) that prohibits “procurement and operation of unmanned aircraft systems manufactured or assembled by an American Security Drone Act-covered foreign entity”. This is an amendment to the Federal Acquisition Regulation (FAR) and, thus, applies to federally funded efforts.

Please note that this applies to both procurement and operation; unmanned aircraft systems manufactured or assembled by an American Security Drone Act-covered foreign entity may neither be purchased with federal funds, nor utilized in projects that are funded federally.

The consolidated screening list has a search capability that is helpful (the CSL Search list; CSL = Consolidated Screening List). Please note that while many entities are on the Consolidated Screening List, one key entity that is included here is DJI. Thus, this new rule has a major impact.

While this rule only applies to federal projects, please keep in mind that the ND Legislature is considering related bills for the upcoming 2025 legislative session. We are working with the ND Legislature to communicate potential challenges. For instance, for counter-UAS testing we may need to fly drones that are on the consolidated screening list. Federal entities have waiver processes in place that enable such operations. We are working with the state of ND such that these possibilities are not superseded and critically-needed research is not halted. However, we do not yet know what will result from the 2025 session.
